1. Acceptance of terms
By accessing or using VivaWork (the "Service"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree to these Terms, you may not use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Who we are
VivaWork is a personal brand operated by an independent sole operator, not a company or a registered legal entity. References to "we", "our", or "us" in these Terms refer to the VivaWork operator.
The operator's full legal name and verified operating address are provided to Stripe as part of identity verification and are made available on request to regulators, chargeback reviewers, and users with a legitimate legal need.

3. Eligibility
You must be at least sixteen (16) years old to use the Service. By using the Service, you represent that you meet this age requirement and that you have the legal capacity to enter into these Terms in your place of residence.
4. Accounts
To access most features, you must register for an account. You agree to provide accurate and current information, to keep your login credentials confidential, and to notify us promptly of any unauthorized access. You are responsible for all activity that occurs under your account.
We may suspend or terminate your account if we reasonably believe you have violated these Terms, the Acceptable Use Policy, or applicable law.
5. The Service
VivaWork provides AI-assisted interview preparation, including mock interview sessions, role-specific question packs, and automated feedback. The Service is offered on an "as is" and "as available" basis. AI-generated content is meant as practice material and may contain errors; it is not professional career, legal, medical, or employment advice.
We may update, modify, or discontinue any part of the Service at any time. Where such changes materially affect paid features, we will make reasonable efforts to notify you in advance.
6. Subscriptions, credits, and payments
Paid plans are billed in advance on a recurring basis (monthly) through Stripe. Credit top-ups are one-time purchases processed at checkout. All prices are shown in US dollars. Applicable taxes may be added at checkout based on your billing location.
One US dollar equals 100 credits. Subscription credits reset at the start of each billing cycle. Top-up credits remain valid for twelve (12) months from the date of purchase. You are responsible for all charges incurred under your account. If a payment fails, we may suspend access until the balance is resolved.
You can cancel your subscription at any time from your account. Cancellation stops future renewals; access continues until the end of the current billing period. Refunds are handled under our Refund Policy.
7. Acceptable use
You agree to use the Service in accordance with our Acceptable Use Policy. Prohibited activities include, without limitation, attempting to reverse engineer the Service, overwhelming or disrupting the infrastructure, uploading unlawful content, impersonating others, or using the Service for illegal or harmful purposes.
8. Intellectual property
VivaWork, its logos, software, interfaces, question banks, and content produced by our systems (excluding your inputs and content you generate) are owned by VivaWork or its licensors and are protected by copyright, trademark, and other laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for its intended personal or internal business purpose.
You retain ownership of the content you submit, including your interview answers. By submitting content, you grant VivaWork a limited license to process that content solely to operate and provide the Service to you.
9. Feedback
If you send us suggestions, ideas, or feedback, you grant us a perpetual, royalty-free license to use that feedback without restriction to improve the Service.
10. Third-party services
The Service may integrate with or rely on third-party services, including Stripe for payments and cloud providers for infrastructure. Your use of these services may be subject to their own terms and privacy policies.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED USE. VIVAWORK DOES NOT GUARANTEE ANY PARTICULAR INTERVIEW OR CAREER OUTCOME.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIVAWORK AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.
OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO VIVAWORK IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED US DOLLARS (USD 100), WHICHEVER IS GREATER.
13. Indemnification
You agree to indemnify and hold VivaWork harmless from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms, or your violation of the rights of any third party.
14. Termination
You may stop using the Service at any time and delete your account. We may suspend or terminate your access to the Service for any violation of these Terms, for fraud or abuse, or as required by law. Upon termination, provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, and limitation of liability.
15. Governing law and disputes
These Terms are governed by the laws of the country in which the VivaWork operator resides. Disputes will be resolved by the competent courts of the place of residence of the VivaWork operator, unless mandatory local consumer-protection law provides otherwise.
16. Changes to these terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, provide additional notice. Your continued use of the Service after the update constitutes acceptance of the revised Terms.
